With all of the hoopla in the United States over the legality-illegality of online gambling and online casinos use there, it can be easy to overlook the legal battles related to the online casinos industry in North America’s northernmost dominion, Canada. The current battle is being waged over a "loophole" which allows online poker rooms to advertise on Canadian television. Online poker has recently seen a surge in popularity that has given observers, critics and enthusiasts pause as to how proceed further in the various struggles to legitimize what many see as an illegal practice and what other’s see as a way to test out their poker skills online.
According to a recent newspaper article in Canada, Critics say broadcasters should close the "loophole" that allows on-line poker rooms to advertise on Canadian television: "With online poker's recent surge in popularity, sports channels are filling their broadcast schedules with online poker Texas Hold Em tournaments, and online poker websites are eager to advertise. The Criminal Code makes it illegal to advertise Internet gambling of any kind in Canada, but many broadcasters welcome advertising from 'play money' versions of popular casinos and online poker rooms like Party Poker, Tiger Gaming and Poker Stars. One Toronto-based Internet gaming consultant said the practice of allowing such online poker ads makes Canadian regulations look ridiculous because online casinos, online poker rooms and broadcasters have found a way around them. In Canada, most private television broadcasters submit commercials to a self-regulatory industry association called Telecaster Services before they're aired."
Without a doubt, the war being waged over the future of online gambling and online casinos and online poker room operations in particular is sure to heat up before it cools down. While there are laws in the United States that prevent online casinos from operating under previously passed regulations regarding the use of phone lines, there are no specific federal laws which specifically prohibit the operation or use of online casinos and online poker rooms. Were the U.S. government and Canadian government to team up to create a bilateral agreement on online casinos and online poker regulations, the future of online gambling on the North American continent might seriously be called into doubt, but given the rising popularity worldwide it is doubtful such regulations would have widespread grass-roots support.
